In search of the “true” transexual person: about the production of differential dignity and citizenship

This article investigates classification systems and patterns of political subjectivity underlying the argumentative logic elaborated by magistrates when judging pleas for rectification of name and “sex” in legal documents demanded by transexual people in Brazilian State Courts. From my master’s research and the analysis of judicial decisions published from 2000 to 2014, I propose the questioning of the universalizing model of citizenship presented by Law and point meanings of suffering, merit, illness and personhood, as well as to the articulation of social markers of difference, such as gender as sexuality, as elements that establish the acknowledgement of entitlement to rights.
