Robert Cover, the “linguistic turn” and the constitutional interpretation

The present essay aims to analyze the positions of Robert M. Cover on legal interpretation, from the main notions of nomos and narratives explored by Cover. With the identification of the elements, a comparison will be made with the currents of empirical tradition of legal hermeneutics, generated from the so-called “linguistic turn”, and its relation with the constitutional interpretation, to which converge the main questions regarding to the construction of the jurisprudential narrative and its transforming effect of the legal universe. As a result, we intend to identify the limits of the activity of interpretation of legal texts, common in Cover’s work and the contemporary doctrine of legal hermeneutics.
