The Convention on the Protection and Promotion of the Diversity of Cultural Expressions

This paper examines the Brazilian constitutional rules which protect and promote diversity of cultural expressions and their connection to the recent Unesco Convention of the Protection and Promotion of the Diversity of Cultural Expressions. This is an important issue in the Brazilian Constitutional Law, because if this Convention is approved under certain conditions, it would acquire the status of a Constitutional Ammendment. Brazil has not ratified the Convention yet; however, the Constitution comprehends the greater part of the Convention, except for the provisions connected to the production of cultural goods and services. The problem is the effectiveness of these rights. Another aspect concerns the Brazilian multiculturalism, as shown recently with the adoption of quotas system to promote equality in the access to public undergraduate system. This is a very sensitive issue at the moment, due to the idea that Brazil is a multicultural and multiracial country that has integrated all different groups that compose this society. The quota policy challenges this idea: is the Brazilian society integrated after all?
