Towards a new 1984? Protection of privacy between the invasion of privacy and the waived privacy

Abstract

This paper presents an analysis about the right to privacy on the Internet. The book 1984, written by George Orwell in 1948, served as a background, because it is repeatedly cited by jurists to exemplify life in a world without privacy. A contemporary overview on privacy on the Internet was described as well as the absence of privacy in social networks and by the use of mobile phones. Reflections of several jurists about this subject were rescued, which, contrary to what one might imagine, are quite old. Moreover, it was showed alerts that these thinkers let to future generations. Finally, an analysis of two recent Brazilian laws about privacy on the Internet was made, with objections to its ineffectiveness by not adopting the contributions of those jurists in a legal regulation on this subject.
