Contractualism, utilitarianism, the emergence of the individual and of the cooperation I: the methodological and metaphysical foundations of institutions of the state and of the market

The goal of this paper is an application of the rationalist program in order to solve political, economic and juridical problems: the problem of the emergence of cooperation among interacting individuals. Such a problem emerges with the development by Descartes of the core of the rationalist program with the establishment of ontological thesis of the individual as an rational and autonomous agent and the geometry as new model of science. The model of rational choice is made of the faculties of understanding and will. This model transforms the individual into a responsible agent therefore, with the Hobbes, the foundation of the civil and criminal laws. Hobbes applies the rationalist program to build up the contratualist program with the state as the solution for the cooperation problem and through this way to build up a new image of the world radically different from that of Aristotelian world. The classical rationalist program is replaced by Hume, by the neoclassical rationalist program. This last program is applied, by Hume and Bentham, to build up the utilitarianism program in replacement to the contratualism program. The utilitarianism brings the market, in addition to the State, as solution for the cooperation problem. The understanding of the development of both of these two programs, contratualism and utilitarianism, depends upon the understanding of the relation between the metaphysics, methodology of the new image of the world and politics, economics and law of institutions of state and marked as their instruments of construction.
