“We are the people” and “we are (afraid of) the people”: Rousseau and the federalist papers at the core of the two constitutional democracy modern strands

The purpose of this essay is (i) to clarify the concept of person and the theory of justice embedded in The Social Contract (by Jean-Jacques Rousseau), and embedded in The Federalist Papers (by Alexander Hamilton, James Madison, and John Jay); and (ii) to point out how these differences affects the relationship between constitutionalism and democracy for the authors. Specifically, I point out how both authors are concerned with factionalism and with the tyranny of the majority, even though they address these concerns in quite different ways.
