Abstract

This paper intends to point out how the conventional view of the economic analysis of law – the one that emphasizes efficiency as a value and explanatory criterion of legal decisions – is only one of the strands opened by the neo-institutionalist economic approach to law. In addition to recasting the conceptual bases of the economic analysis of law in the new institutional economics, the text seeks to indicate contemporary approaches that are integrated within this theoretical body, such as the study of institutional alternatives (alternative decision-making arenas where economic choices are made) and of behavioral incentives standards by different choice architectures. A broad spectrum of theoretical tools opens up for the comparison and design of institutions on the interface between law and economics.
