Abstract

Acts of admnistrative improbity, according to the precedents of the brazilian Supreme Court of Justice, demand the presence of the subjetive element of intent – or, according to the majority of the doctrine, serious fault, on those cases of the article 10 of the Law n. 8.429/92, the ones that cause damage to the public coffers. There are, however, differences between irregularities and illegalities from those acts of improbity, per se. Therefore, the present article is an analisis of the need of subjetive intencionality and bad faith in doing these acts in order to convict the public agent on the punishment of the Administrative Improbity Law.
